Welcome to buya.org. buya.org and its affiliates provide their services to you subject to the following conditions. If you visit or donate at buya.org, you accept these conditions. Please read them carefully. In addition, when you use any current or future buya.org service or visit or purchase from any organization affiliated with buya.org, whether or not included in the buya.org web site, you also will be subject to the guidelines and conditions applicable to such service or organization. DESCRIPTION OF SERVICE
Buya.org is a non-profit 501(c)(3) tax exempt organization dedicated to serving the poor and disadvantage by networking grass root charities with those that want to make a difference in this world. buya.org works with charities that have a proven track record 
of helping the poor and disadvantaged, by and connecting them with donors who purchase charitable products from the buya.org website. Buya.org serves as a clearinghouse for charitable donations, directing donor funds to the charitable organization whose product the donor selects on the buya.org website. Buya.org collects the donor funds, as well as a small fee to cover transactional expenses, and delivers them to the charitable organization for use in the manner contained in the product description.

ELECTRONIC COMMUNICATIONS
When you visit buya.org or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

LICENSE AND SITE ACCESS
Buya.org grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of buya.org. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of buya.org. You are granted a limited, revocable, and a nonexclusive right to create a hyperlink to the home page of buya.org so long as the link does not portray buya.org, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use the buya.org logo or any other proprietary graphic or trademark as part of the link without express written permission provided buya.org is not portrayed in a false misleading or otherwise offensive manner.

REPRESENTATIONS AND WARRANTIES
You represent and warrant that (a) all of the information provided by you to buya.org to participate in the Services is correct and current; and (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder.

INTELLECTUAL PROPERTY RIGHTS
You acknowledge that buya.org owns all right, title and interest in and to the Service content displayed on buya.org, including without limitation all intellectual property rights (the "buya.org Rights"), and such buya.org Rights are protected by U.S. and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works from the Service. The buya.org Rights include rights to (i) the Service developed and provided by buya.org; and (ii) all software associated with the Service. The buya.org Rights do not include third-party content used as part of buya.org website, including the content of communications appearing on the Service site.

YOUR ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use buya.org only with involvement of a parent or guardian. Buya.org and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

PRODUCT DESCRIPTIONS
Buya.org and its affiliates attempt to be as accurate as possible. However, buya.org does not warrant that product descriptions or other content of this site are accurate, complete, reliable, current, or error-free. Buya.org reserves the right to substitute equivalent products to those purchased if the original product becomes unavailable, or has been purchased by another customer.

PRICING
Except where noted otherwise, the Price displayed for products on the buya.org website represents the full price of the product itself inclusive of the buya.org transactional service charge. Buya.org will NOT charge your credit card until after your order has been matched with the desired product or its equivalent. Despite our best efforts, and due to the unique nature of many products listed on the buya.org website, a small number of the items in our catalog products may be unavailable at the advertised price at the time of purchase because they have been previously purchased by another donor. In the event the displayed product is unavailable, buya.org reserves the right to substitute a substantially similar product in place of the advertised product, or to cancel the transaction. In the event the transaction is cancelled, buya.org will contact the donor with the reason for the cancellation. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before processing your order or cancel your order and notify you of such cancellation. Please note that this policy applies only to products listed and sold on buya.org. Buya will be charging the credit card upon purchase.

APPLICABLE LAW
By visiting buya.org, you agree that the laws of the state of Minnesota, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and buya.org or its affiliates.

DISPUTES
Any claim or Any dispute brought against buya.org relating in any way to your visit to buya.org or to products you purchase through buya.org shall be submitted to confidential arbitration in Saint Paul, Minnesota. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The aribitrator shall be a mutually agreeable person of adequate competence. If the parties cannot agree on an arbitrator, each party will select one arbitrator, and those two arbitrators will select a third. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. In no way shall this section apply to claims brought by buya.org. buya.org shall be free to bring claims in any court of competent jurisdiction.


SITE POLICIES, MODIFICATION, AND SEVERABILITY

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time.
